The current financial crisis has led to an unprecedented amount of new rules and regulations around remuneration in the financial services industry. At a European level, the new Capital Requirements Directive IV (‘CRD IV’) regarding banks and investment firms entered into force on January 1st, 2014. One of the main topics of this Directive is remuneration, with its most important rule being the bonus cap.

The CRD IV has the status of Directive, which means it must be implemented by the member states in their national law. In light of this, The Netherlands will introduce a bonus cap in its national law. The Remuneration Policy of Financial Undertaking (‘Wbfo’) will most probably enter into force on January 1st, 2015. Where the percentage of variable remuneration in the CRD IV is maximized at 100% of fixed remuneration (and under certain circumstances 200%), under the draft new rules variable remuneration in The Netherlands will be maximized at only 20%. Furthermore, the Dutch rules will apply to almost every financial institution and to every person working under its responsibility, whereas the European rules apply to only ‘Identified Staff’ (material risk takers) of banks, building societies and certain investment firms.

Come to our FSI Round Table that will be held on Thursday September 18th at the Crystal Tower in Amsterdam. ‘Rewards in the Financial Service Industry’ will be the overarching theme of this session, in which topics such as CRD IV, Rbb2 and the new Dutch ‘Wbfo’ law for the FSI will be discussed from multiple perspectives. Inspirational speakers from different fields of expertise will share their views and discuss their ideas on how to deal with new and upcoming FSI legislation for both Dutch and international perspective. The session will be held in English.

The session will be led by Caroline Zegers, Partner of Deloitte in The Netherlands and thought leader in the field of executive and equity compensation.
